A 69-year-old man who fatally stabbed one of two men attempting to rob him on a Queens subway train appears to have acted in self-defense and has not been charged, ABC News reports.

The incident occurred early Sunday around 12:30 a.m. on a Manhattan-bound No. 7 train in Woodside. The man was asleep when a group of individuals stole his bags.

Upon waking, he attempted to retrieve his belongings, leading to a struggle during which he pulled a knife. He stabbed a 32-year-old man in the chest, who later died at Elmhurst Hospital, and slashed another man in the face, who is currently receiving treatment.

The Queens District Attorney's Office has declined to prosecute the man, citing evidence suggesting he acted in self-defense.
