The bus driver involved in the crash that claimed the lives of a kindergartner and his mother outside a Mamaroneck school will not face criminal charges, ABC 7 news informs.
The tragic incident occurred on June 20 around 8:30 a.m. near Mamaroneck Avenue School, located at Mamaroneck Avenue and New Street. Six-year-old Michael Donovan Volpe was pronounced dead at the scene, while his mother, 43-year-old Molly Murphy Donovan, was taken to the hospital, where she later died.
The 68-year-old bus driver will receive three summonses, including one for using a cell phone while driving, although it was determined he was not on the phone at the time of the crash and was not speeding.
The press conference held by police and officials was attended by many parents of fellow students.
At the time of the accident, several parents and children were crossing the street at the crosswalk with the walk signal as the bus was turning.
The reason the bus driver did not yield to pedestrians remains unclear, but parents have long called for a crossing guard at that location.
“There’s no excuse,” said Lori Lyons, a Mamaroneck resident, back in June. “No excuse for the village of Mamaroneck to have not have had somebody out here for years for this to be going on. This should've never happened today.”
